1. Acceptance of Terms
By creating an account or downloading Blendpoint, you agree to be bound by these Terms of Service. If you do not agree, do not use the software or services.
2. Description of Service
Blendpoint is a professional RAW photo conversion application ("Software") developed and operated by Skytte Visuals ("we", "us", "our"). The Software converts camera RAW files to DNG, merges HDR bracket sequences, and provides delivery tools for architectural and real estate photographers. Access to the full Software requires a paid subscription following a 30-day free trial.
3. Free Trial
New accounts receive a 30-day free trial beginning from the first launch of the Software on a registered machine. No credit card is required to start a trial. At the end of the trial period, the Software will be locked until a subscription is purchased. Trial access is limited to one machine per account.
4. Subscriptions and Payment
Blendpoint is available on a monthly (€9.99/month) or annual (€79/year) subscription basis, with equivalent DKK pricing for Danish customers. Subscriptions are billed in advance and renew automatically at the end of each billing period. You may cancel at any time through your account dashboard; cancellation takes effect at the end of the current billing period. Payments are processed securely by Stripe. We do not store your payment card details.
5. Licence
Upon active subscription, we grant you a personal, non-exclusive licence to install and use the Software on one (1) machine at a time. You may transfer your licence to a new machine at any time through your account dashboard; doing so will deactivate the previous machine at its next weekly verification. You may not run the Software on more than one machine simultaneously. You may not sublicense, sell, rent, or share your licence key with any third party. Decompiling, reverse engineering, or modifying the Software is not permitted.
6. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or share licence keys with unauthorised users.
7. Intellectual Property
All intellectual property rights in the Software, including its design, code, and branding, remain the exclusive property of Skytte Visuals. Your RAW files and output files remain entirely your property. We do not claim any rights over files processed through the Software.
8. Disclaimer of Warranties
The Software is provided "as is" without warranty of any kind. We do not warrant that the Software will be error-free, uninterrupted, or compatible with all hardware configurations. You use the Software at your own risk. We strongly recommend keeping backups of all original files before processing.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Skytte Visuals shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, loss of revenue, or business interruption arising from your use of the Software. Our total liability shall not exceed the amount you paid for the Software in the twelve months preceding the claim.
10. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of material changes by email or through the website. Continued use of the Software after changes take effect constitutes acceptance of the updated terms.
11. Governing Law
These terms are governed by the laws of Denmark. Any disputes shall be subject to the exclusive jurisdiction of the courts of Denmark.
